Oaks Subdivision - Cal Am Water Agreement

On May 6, 2014, the County of Monterey and California American Water Company (Cal Am) entered into a Memorandum of Understanding (MOU) to formalize and implement Cal Am’s agreement to offset Cal Am’s water service to the approved nine-lot Oaks subdivision with an equal amount of water from the Oaks’ subdivision well, so as to result in no net transfer of water. The Oaks subdivision is located near San Benancio Road in the unincorporated area of Monterey County. This web page summarizes some of the terms of the MOU, but for the complete terms of the MOU, the reader is referred to the MOU itself.

The MOU requires Cal Am to balance the volume of treated water sent from the Ambler Park Water System to the Oaks subdivision and the volume of raw water sent from the Oaks well to the Ambler Park Water System, so as to result in an equal amount of water being exchanged, including calculated transportation loss. The MOU puts in place monitoring and reporting requirements to ensure this equal exchange.

A water audit report must be prepared by a qualified engineer experienced in water system operations and be completed quarterly. The water audit report must be sent to Monterey County Health Department Environmental Health Bureau (EHB) for review with a copy to the Monterey County Water Resource Agency (MCWRA) no later than thirty (30) days following the end of that quarter. If there is any discrepancy in the amount of water that is transferred from the Ambler Park Treatment Plant to the Oaks Subdivision and from the Oaks well back to the Ambler Park Treatment Plant, then EHB may require Cal Am to take such steps as EHB requires to bring the transfer into balance. Cal Am shall begin quarterly pumping of the Oaks well into the Ambler Park system in the first quarter after the Oaks well has been permitted into the Ambler Park system by the California Department of Public Health. The first pumping of the Oaks well shall include an amount of previous water delivered to the Oaks Subdivision to balance any previously transferred water.

The MOU also requires that Cal Am maintain the water meters in good working order. Within the first sixty (60) days of each calendar year, Cal Am is required to have qualified personnel test these meters. Cal Am is to send the report with the results of this meter testing to EHB with a copy to MCWRA within 30 days following the end of the first quarter of each calendar year; the MOU permits this report to be combined with the water audit report.

This MOU pertains only to the nine (9) lots in the Oaks Subdivision and does not include any other properties. This web page includes a copy of the complete MOU and will include the quarterly audit reports submitted by Cal Am.
