Legislative Issues Assembly Bill 109 Realignment, which shifted thousands of state prison inmates to local jurisdictions. Proposition 47, which dramatically reduced the crime and consequences for drug users and thieves. Proposition 57, which eliminated prosecutors’ ability to directly send a juvenile accused of a serious or violent offense to adult court and created a new criteria for early release of prisoners from state prison. |

Upon the request of the jurisdictional law enforcement agency the
Monterey County District Attorney’s Office will investigate and
independently review an officer-involved shooting incident resulting
in injury or death, as well as all other uses of force resulting in
the death of individuals while in custody or under the control of
law enforcement officers. This review addresses whether the
officers involved committed any violation of criminal law. It
does not consider issues of civil liability, police tactics, or
department policies and procedures.

Investigation consists of 32 full time employees and multiple
volunteer interns. The Bureau of Investigation is managed by
Chief Investigator Ryan McGuirk who reports directly to District
Attorney Jeannine M. Pacioni and has overall responsibility for
Bureau operations and resource allocation. Chief McGuirk manages the
Bureau of Investigation with the assistance of two (2) District
Attorney Captains. In addition to these command staff, the
Bureau of Investigation has twenty-four (24) Investigators, six (6)
Investigative Aides and several volunteer investigative interns.

I would like to receive child support. Does the District Attorney’s Office help to begin this process?
No. Anyone who has a child support and/or medical support order, or wants to establish one, can apply for child support enforcement services by completing an application form (available at Salinas, Seaside and King City Child Support Services offices). After the application form is signed, the child support process begins. For further information and to obtain forms, please visit their website at: https://www.countyofmonterey.gov/css or by calling (831) 755-3700.I want a restraining order to keep my spouse, boyfriend/girlfriend, or other person away from me. Will the D.A.'s Office do this for me?
No. There are several community agencies within this community that can assist you with obtaining a restraining order. For agency information go to: https://www.countyofmonterey.gov/government/departments-a-h/district-attorney/dvcc and click on Domestic Violence Brochures. You can also file the paperwork yourself. Forms can be obtained online at: www.ezlegalfile.com- All criminal activity must be reported to the police agency which has jurisdiction over the area in which the crime occurred. Once the agency completes their investigation, the report will be forwarded to our office for review by a deputy assigned to our Domestic Violence Unit.

- If you are represented by an attorney, he or she will obtain a copy of the police report at the time of arraignment. If you do not have an attorney, the report will be released directly to you during your court arraignment.
I have a question regarding a letter that Ms. Pacioni sent to me. Is he the person that I need to speak to regarding my case?
Since Ms. Pacioni is the District Attorney for the County of Monterey, her name appears on all of our letterhead. Please refer to the name of the deputy district attorney which is located in the signature area of your letter. If you are a defendant and are represented by an attorney, all attorneys are governed by a code of ethics which prevents them from speaking directly to anyone who has an attorney. As long as you are represented by an attorney, we may speak only to your attorney.If I was cited and released by a local police agency, how can I find out if the D.A. has filed charges against me?
You can obtain this information by calling (831) 755-5070.I have been subpoenaed by the District Attorney to appear as a witness in a criminal case. Am I entitled to get witness fees? What if I am unable to attend the court date stated in the subpoena?
Witness fees are within the discretion of the court. You may be granted witness fees plus reasonable and necessary expenses after testifying. If you are unable to attend the date indicated in the subpoena please contact the Deputy District Attorney who is handling the case as soon as possible (before the appearance date) to discuss your conflict. Their name and contact information is on your subpoena.- Yes. Our attorneys are part of a statewide network of consumer and environmental prosecutors throughout California and are referral sources for issues or complaints which may be handled in other jurisdictions. If I am the victim of a violent crime will the District Attorney's Office pay for my lost wages and medical expenses? Am I eligible to receive restitution?
Once the case has been filed, our Victim/Witness Assistance Unit can advise you of services that are available to victims. If the court grants you restitution, our Restitution Specialist will be able to assist you during this process. You may contact both units by calling: (831) 755-5070 or 755-5072.Can I find out information on a case such as a defendant’s next court date and what charges were filed?
Yes. Our office can assist you with questions that relate to items considered to be of public record. To obtain this information, please call (831) 755-5070 or visit the court’s website at: www.monterey.courts.ca.govA: Once a report has been forwarded to our office, the ultimate filing decision will be determined by the filing deputy on behalf of the People of the State of California. Requests made by a victim will be taken into consideration during the reviewing process. If you are a victim of a violent crime, you can contact our Victim/Witness Unit at (831)755-5070 for further assistance.
A: Incidents should be reported as follows:
Crimes must be reported to the police department or other law enforcement agency which has jurisdiction over the city or county where the crime occurred. Crimes committed in the unincorporated area of Monterey County should be reported to the Monterey County Sheriff's Office.
Crimes involving consumer fraud and environmental crimes should be reported directly to the District Attorney's Consumer/Environmental Protection Unit.
